Q:

How do I know whether I am required to file an expert witness report?

A:

Only those faculty or staff members who meet ALL of the following criteria are required to report.

• Full-time, non-classified employees
• Member of the faculty or staff
• Duties include teaching, research, administration or performing professional services, including professional library services
• Received compensation for service as a testifying expert witness in a lawsuit or a consulting expert witness whose name had to be disclosed to the other party during the lawsuit in accordance with state or federal law
• The State of Texas (including state agencies and public institutions of higher education) was one of the parties being sued
• The compensation was for services rendered during the past fiscal year (September 1st through August 31st)
